====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-09-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application against petitioner nos. 1 and 3 as they have been arrested during pendency of the present anticipatory bail application. Permission is accorded.

Let the defect(s), if any, be removed within a period of four weeks.

The petitioner no. 2 apprehends his arrest in a case

Patna High Court CR. MISC. No.13283 of 2022(2) dt.15-09-2022 2/3 registered for the offences punishable under Sections 302, 120(B), 201 and 34 of the Indian Penal Code.

The informant alleges that he has solemnized marriage of his daughter with Vijay Das and on 09.05.2021 at about 9:00 am, he received a call from his daughter thereafter he reached her matrimonial home but did not find his daughter nor her in-laws hence, suspected that she has been killed.

Learned counsel for the petitioner submits that petitioner is the elder brother-in-law of the deceased and is separate in mess and property from the husband of the deceased and the husband of the deceased is in custody. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioner, the petitioner no. 2, namely, Ajay Das, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with
