JUSTICE BIRENDRA KUMAR ORAL ORDER 14-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/341/323/ 326/ 307/302/504/506 of the Indian Penal Code and Section 3/4 of the Dayan Act.

There is general and omnibus allegation against eleven FIR named accused persons to have assaulted to the wife and son of the informant alleging that she is a witch as a result of assault the wife of the informant and son died subsequently.

Submission is that the allegation is general and omnibus. The petitioner has got no criminal antecedent and he is

Patna High Court Cr.Misc. No.2241 of 2018 (3) dt.14-03-2018 P2/ in custody since 18.09.2017. The investigation is complete now and petitioner is ready to cooperate.

Considering the entire facts, let the petitioner, above named, be released on bail after framing of the charge or after completion of three months of custody whichever is earlier on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Marauna P.S. Case No.100 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
