The petitioner is languishing in custody since 07.08.2018 in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code. It is alleged that on 06.08.2018 at 4.30 A.M., the informant parked his motorcycle near booking counter of Bettiah Railway Station, but in the meantime, one person attempted to take away the motorcycle, but was apprehended by the public on alarm being raised by Panchayat Secretary. It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been roped in the present case. It is further submitted that the

Learned APP for the State submits that the petitioner was caught red handed.

Considering the fact that the investigation has already been concluded, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Railway, Bettiah, West Champaran, in connection with Rail Sugauli (Bettiah) P.S. Case No.39 of 2018.
