JUSTICE RAJIV ROY ORAL ORDER 12-03-2026 Learned counsel for the petitioner prays for and is allowed to correct the typographical error in the plain portion, inasmuch as, the petitioner, Saiyad Jaki Ahmad gender was typed as female instead of male.
2. Heard the parties.
3. The petitioner is apprehending his arrest in connection with Baligaon P.S. Case No. 117 of 2025 for the offence under sections 191(2), 191(3), 190, 323, 192, 132, 109, 351(2), 326(6) and 324(6) of the BNS and Section 3, 7 and 9 of Bihar Control of Use and Play of Loud Speakers Act lodged on 08.07.2025 by the informant, Sunil Kumar.
4. As per the prosecution story, the accused persons blocked the National Highway-28 during a procession
2/4 alongwith loud DJ music and no one was ready to clear the said National Highway for the movement of the tourist. In the meantime, a motorcycle rider hit the bus coming from Samastipur which followed the accused persons putting the bus on fire as also assaulted the bus driver. This led to the FIR.
5. Learned counsel for the petitioner submits that he is a passerby, was present at the wrong place, got implicated. Further, he do not have criminal antecedent and to show his bona fide, wants to contribute Rs. 5,000/- to the Chief Minister's Relief Fund.
6. Learned APP opposes the prayer submitting that allegation is of blocking the National Highway beside putting the bus on fire and attacking the bus driver.

Taking into account the submissions of the parties as also that omnibus allegation is there against him and has no criminal antecedent, in that background, this Court is inclined to extend him the privilege of anticipatory bail with conditions subject to payment of Rs. 5,000/- to the Chief Minister's Relief Fund through Demand Draft and the receipt be submitted to the learned trial Court.
8. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the
3/4 receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Baligaon P.S. Case No. 117 of 2025 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhaar Card/Voter ID Card/Pan Card/Driving License) to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every week for six months to mark his attendance and after the end of the period, the certificate shall be submitted before the Trial Court failing which steps shall be taken for the cancellation of the bail bonds; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
4/4 (v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
