JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Deoriya P.S. Case No. 34 of 2016, registered under Section 304-B/34 of the Indian Penal Code.

The accusation is of killing of the daughter of the informant due to non-fulfillment of demand of dowry by her husband and other in-laws.

Learned counsel for the petitioner submits that, in fact, the petitioner is the husband of the deceased and his wife, daughter of the informant, sustained burn injury in course of cooking meal and she was rushed to treatment at Maa Janki Hospital, Muzaffarpur, where ASI Rajendra Kishore Singh, Ahiyapur P.S. recorded her statement in which she detailed that

Patna High Court Cr.Misc. No.27673 of 2017 (2) dt.12-07-2017 2/2 she met with fire in course of cooking meal, which has also detailed in the case diary by the I.O. during the course of investigation. Further submission is that petitioner is in custody since 17.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Muzaffarpur in connection with Deoriya P.S.
