Petitioner is in custody in connection with Ahiyapur P.S. Case No. 1197 of 2019 for the offence under sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Referring to prosecution case, learned counsel for the petitioner submits that informant has raised suspicion about involvement of Ghanshyam Patel and Baby Patel in the killing of his father. He further submits that petitioner was not named in the FIR. His name surfaced on the basis of confessional statement of co-accused.

Considering the fact that petitioner was not named in the FIR and the informant suspected involvement of Ghanshyam Patel and Baby Patel on account of certain land dispute, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 1197 of 2019 subject to the condition that on release the petitioner shall render his service as volunteer in dedicated Covid hospital for a period of one month and he has to report to the Nodal Officer in the concerned region who shall utilize the service of the petitioner appropriately.
