The petitioners, two in number, apprehend their arrest in a case registered under Section 353 and other sections of the Indian Penal Code.
The allegation is that two persons were confined after scuffling between two groups of a village. The police went there but the villagers made protest and started pelting stones. It is submitted that the petitioners are named in the F.I.R. but no specific allegation is made against the petitioners. Similarly situated co-accused Naresh Chauhan has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 4271/2015.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the
Patna High Court Cr.Misc. No.6797 of 2015 (2) dt.19-02-2015 2/2 learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Akbarpur P.S. Case No. 242/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
