The petitioner is accused in connection with Jhajha P.S. Case No. 119 of 2016, registered under Sections 323, 504, 376 and 493 of the Indian Penal Code.

The accusation is that husband of the complainant was traceless since 10 years due to that reason she used to come at Jhajha Block Office. In that course, petitioner met with the complainant and developed physical relation several times on assurance to perform the marriage. On 11.03.2016, petitioner perform the marriage with another girl, on which, when the complainant went at the house of the petitioner then petitioner

Patna High Court Cr.Misc. No.27700 of 2017 (2) dt.12-07-2017 started to abuse and assault through fist and slaps. Learned counsel for the petitioner submits that it would appear from the F.I.R. that the informant is married lady and she has four major sons and her husband is traceless since 10 years. While the complainant asked to perform the marriage with the petitioner but the petitioner refused due to that reason the complainant lodged the present case with false allegation only to give undue pressure. It is further submitted that petitioner has no criminal antecedent and is in custody since 15.01.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jamui, in connection with Jhajha P.S. Case No. 119 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
