JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sessions Trial No. 721 of 2016, arising out of Mainatand P.S. Case No. 97 of 2016 registered under Section 302/34 of the Indian Penal Code, pending in the court of learned Sessions Judge, Bettiah, West Champaran.

The accusation is of killing the daughter of the informant by her husband due to protest by daughter of informant regarding illicit relation with his sister-in-law, Salamun Nesha. A supplementary affidavit has been filed on behalf of the petitioner. Learned counsel for the petitioner submits that the

No.27704 of 2017 (2) dt.12-07-2017 dead body of deceased, daughter of the informant, was found at the house of the petitioner, husband of the deceased, due to that reason petitioner has falsely been implicated in this case mere on suspicion. Further submission is that informant and her son have not supported the prosecution case.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
