Petitioner is apprehending arrest in connection with G.R. No. 2717 of 2019 arising out of Karai Parsurai P.S. Case No. 169 of 2019 for the offence under sections 420, 406, 120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
In the instant case, the allegation against the petitioner is that he has misappropriated the government money allotted to him for construction of water pipe and drain under Mukhiya Mantri 7 Nishachya Yojna.
Learned counsel for the petitioner submits that the petitioner is Ward Member and his ward the work of Mukhiya Mantri 7 Nishachya Yojna, water pipe and drain has been done and no government money was misappropriated. He further
Patna High Court CR. MISC. No.14238 of 2020(2) dt.03-07-2020 2/2 submits that the petitioner is innocent and he has committed no offence as alleged in the FIR and with a view of malign is prestige he has falsely been implicated in the present case. He next submitted that the Mukhiya of panchayat is the custodian of the cheque.
Considering the fact that petitioner has no criminal antecedent and he is ward member, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Karai Parsurai P.S. Case No. 169 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that both the bailors should be elected representatives of the locality.
