JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant. In her statement under Section 164 of the Cr.P.C., the age of the victim girl has been recorded as 19 years when the court has assessed her age as 17 years though as per medical report she was found 22 years. In her statement, the victim girl has stated that she has married with the petitioner and she has never been kidnapped.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12
Patna High Court Cr.Misc. No.8981 of 2015 (2) dt.04-03-2015 2/2 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in connection with Amarpur P.S.Case No. 99 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
