This petition is directed against the order dated 21.01.2014 passed by the learned S.D.J.M., Katihar in connection with C.A. Case No. 2589 of 2012 whereby cognizance has been taken under Section 498A of the Indian Penal Code.

There is nothing on record to indicate about the stage of the case. Since the order has been passed in the year 2014, in all its probability the case may have concluded by now.

In any event, if the case still continues, the

No.14944 of 2015(2) dt.10-05-2019 2/2 petitioners would have the opportunity of approaching the court below for the necessary relief to which they are entitled, if such petition has not already been filed and disposed of. If the case is pending trial, the trial court would be under an obligation to conclude the trial as early as possible.

All the aforesaid observations would be of avail only if the case is still alive for consideration. With the aforesaid direction/observation, the petition is disposed of.
