The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 323, 498(A), 376, 511, 420, 406/34 of the Indian Penal Code. There is allegation of commission of torture for dowry against petitioner and other co-accused. As per F.I.R., there is allegation against all the F.I.R. named accused persons that they have cheated the informant and her family by saying that husband of informant is Bank Clerk and in the marriage, father of informant spent Rs. 8 lacs after selling his land. Petitioner happens to be cousin father-in-law. There is general and omnibus allegation. The allegation of trying to commit rape against petitioner is false and fabricated, as the alleged occurrence did not take place. It is further submitted that husband of the informant has already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated
Patna High Court CR. MISC. No.14265 of 2023(3) dt.03-07-2023 2/2 24.06.2023 passed in Cr.Misc. No. 29425 of 2023. Petitioner has got clean antecedent.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Sheikhpura in connection with Ariyari P.S. Case No. 206 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
