JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Dehri Town P.S. Case No. 673 of 2011 registered under Section 414/34 of the Indian Penal Code and 25(1-B)a, 26 of the Arms Act.

As per prosecution case, Co-accused Deepak Kumar Yadav was apprehended with a country made loaded pistol alongwith other items on the truck. In this course Co-accused Deepak Kumar Yadav disclosed the name of the petitioner and other accused persons.

It is submitted by learned counsel for the petitioner that though petitioner is named in the F.I.R. but his name has

Petitioner is quite innocent and has committed no offence as alleged and he has been falsely implicated in this case on wrong allegation. The petitioner has been languishing in custody since 29.03.2012. Coaccused Sanjiv Kumar Poddar and Sonu Paswan having identical allegation have already been enlarged on bail by this Court vide order dated 30.10.2013 passed in Cr. Miscellaneous No. 45503 of and order dated 04.07.2014 passed in Criminal Miscellaneous No. 20610 of 2014 respectively. Considering the facts aforesaid, the above named petitioner is directed to enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-4th, Rohtas, Sasaram in connection with Dehri Town P.S. Case No. 673 of 2011.
