The petitioner seeks bail in connection with Lodipur P.S. Case No. 40 of 2019 dated 08.03.2019 instituted for the offence under Section 392 of the Indian Penal Code.

The petitioner is said to be in custody since 07.05.2019.

The name of the petitioner has transpired on the statement of a witness after two months of the occurrence but there is no corresponding recovery of any looted money from him. Though the petitioner has been made accused in several other cases but in all such cases, he is on bail. Another accused person, who too was named by the same witness and who also had

Patna High Court CR. MISC. No.11127 of 2020(2) dt.28-02-2020 2/2 criminal antecedent, is also stated to have been granted bail by a bench of this Court.

While saying so, this Court has also taken note of the fact that the petitioner has not yet been put on test identification parade.

Considering the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Lodipur P.S.
