JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-03-2019 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Indian Forest Case No. 45 of 2017, in connection with Trial No. 3672 of 2018, disclosing offences under Sections 33, 41 and 42 of the Indian Forest Act and Sections 2, 17, 27, 29, 31, 50 and 51 of Wild Life Protection Act. Two sal trees were found cut in the forest area. It is the case of the prosecution that upon enquiry, the informant learnt about the role of these petitioners in felling of

Learned Counsel on behalf of the petitioners has submitted that there is no tangible basis for implication of these petitioners. The petitioners have no criminal antecedent. Considering the facts and circumstances, this application is allowed.
It is indicated, however, that if the petitioners are found indulging in similar type of offence in future, the prosecution shall be at liberty to apply for cancellation of bail granted in the present case.
Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Trial No. 3672 of 2018, arising out of Indian Forest Case No. 45 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their
