The petitioner seeks bail in Ram Nagar P.S. Case No. 403/2017, instituted for offences under Section(s) 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. It is alleged in the written report that son of informant had gone to his Sasural on motorcycle with one Kaushal Kumar Rai, but he did not return.

Learned counsel for the petitioner has submitted that one U.D. Case No. 15/2017 was filed by the informant on 30.10.2017. Thereafter on the instigation of enemies of petitioner, present case has been lodged against Kaushal Kumar

Patna High Court CR. MISC. No.12037 of 2019(2) dt.27-02-2019 2/2 Rai as accused. Name of this petitioner has come during investigation merely on suspicion on the basis of CDR report. Aforesaid Kaushal Kumar Rai has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 10364/2018 dated 16.03.2018.

Petitioner is in custody since 02.12.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bagaha, West Champaran in connection with Ram Nagar P.S. Case No. 403/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
