JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-10-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of writ in nature of mandamus and directing and commanding the Respondent authorities to inquire into the matter immediately

Patna High Court CWJC No.3704 of 2023(2) dt.09-10-2023 2/3 with regard to Govt. land appertaining plot no.11112 area 40 decimal and plot no.11114 area 46 decimal total area 86 decimal after that might be issued "No Objection Certificate" for making the Govt. Panchayat Bhawan situated at, Resident of Village- Bhasar Machhaha, Balua Tole P.SSitamarhi, Distt. Sitamarhi. Whereby and whereunder private respondents have illegally took possession over the Govt. Land and try to manipulate the khatiyan and prevent to development work of the concern panchayat which is illegal, arbitrary.

(ii). For further direction to the respondents authorities to immediate action order dt.19.11.2022, passed by the Sub-Divisional Claim Redressal officer, Sitamarhi Sadar, Distt.- Sitamari in Complaint case no.9999901190722320303 and the Redressal officer hold that if it was seen all documents and after inquiry upon the matter that rent fixation case no.02/92-93 was pending or tactics to delay attitudes nothing else. Lordships may direction to take appropriate steps for dispossession from the Govt. Land.

After some arguments, the learned counsel for the petitioner seeks to withdraw the present writ petition, to which the learned counsel for the Respondent-State has got no objection.
