The petitioner seeks bail in connection with Majorganj P.S. Case no. 536 of 2017 registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act 2016.
10.5 lts. of Nepali wine is said to have been recovered from the possession of the petitioner while 4.5 lts. of Nepali wine from the possession of Bhantu Paswan and petitioner was apprehended.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from his conscious physical possession. Petitioner has no concern with the seized
Patna High Court Cr.Misc. No.8489 of 2018(2) dt.17-02-2018 2/2 liquor. He has been falsely implicated in the case due to dirty village politics. Though, one more criminal case has been lodged against the petitioner, but he is on bail in the said case. He has been languishing in custody since 13.12.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Majorganj P.S. Case no. 536 of 2017.
