Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 32 of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of nine cases out of which two cases are under the Excise Act and allegation is of recovery of 275 litres of liquor from two cycles.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and he came to be implicated based on secret information which is the easiest way

Patna High Court CR. MISC. No.13532 of 2026(2) dt.16-04-2026 2/2 to implicate someone without holding a proper investigation and he is in custody since 23-10-2025. It is next submitted that charge-sheet has been submitted and if privilege of regular bail is granted to the petitioner, the petitioner will not abscond rather will co-operate in the trial to prove his innocence. 5.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Hemjapur P.S. Case No. 76 of 2025.
