The petitioner is seeking anticipatory bail in connection with Dehari P.S. Case No. 658/2018 registered under Sections 379, 411, 413, 414/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the name of the petitioner has transpired in the statement of the apprehended accused, however nothing has been recovered from the house of the petitioner. It is submitted that the petitioner has got clean antecedent and has never been involved in any act of theft.

Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner. In the given facts and circumstances of the case

Patna High Court CR. MISC. No.11937 of 2019(2) dt.28-02-2019 2/2 wherein the allegation is that he was in possession of a stolen motorcycle but the name of the petitioner has transpired in the statement of the apprehended accused and the petitioner has no criminal antecedent, in the event of his arrest/surrender before the court below within a period of four weeks, let the abovenamed petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri, Rohtas, in connection with Dehri (Town) P.S. Case No. 658/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation.
