The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 448, 341, 323, 337, 338, 504 and 302 of the Indian Penal Code.

The prosecution case in short is that the accused persons came to the house of the informant and assaulted his father due to which he died.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 27.08.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been

Patna High Court CR. MISC. No.11686 of 2020(2) dt.28-02-2020 2/2 submitted in the present case. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made against the petitioners. As per postmortem report, there is no external injury on the body of the deceased. The post-mortem report does not support the allegation made in the F.I.R. Other co-accused has been granted bail vide Annexure-2 to the present application. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VII, Nalanda at Biharsharif in connection with S. Tr. No. 617/2019 arising out of Manpur P.S. Case No. 95/2018.
