JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Pawana P.S. Case No. 20 of 2021 registered for the offences punishable under Sections 147, 148, 149, 188, 342, 323, 324, 325, 307, 379, 411, 353, 354B, 332, 333, 337, 338, 152, 290 of the Indian Penal Code.

As per the prosecution case, death of two persons in a tractor accident, their family members and others were blocked the road and raising slogans against the police and administrator. The mob damaged the vehicle of the C.O and also assaulted the police personnel with lathi and danda and snatched the rifle of the police.

Learned counsel for the petitioner submitted that

Patna High Court CR. MISC. No.14093 of 2023(2) dt.12-05-2023 2/2 petitioner is not named in the FIR and has falsely been implicated in the present case. He submitted that on the basis of confessional statement of co-accused his named has transpired in this case. He submitted that petitioner is an employee of North- East Railway at Varanshi annexed as Annexure-2 of the bail application. No specific overt act has been attributed against the petitioner. It is further submitted that petitioner has clean antecedent as stated in para-3 of this application.

Considering the nature of allegation as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) each with two sureties of the like amount to the satisfaction of the learned Judicial Magistrate, 1stclass, Bhojpur, Ara in Pawana P.S. Case No. 20 of 2021 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) N.
