Petitioner, already in custody, seeks bail in connection with Cheriyabariyarpur P.S. Case No.10 of 2016, registered under Section 387 of the Indian Penal Code. Allegation in brief is that demand of extortion was made from mobile no. 9066204273 from the informant, who is said to be a quack.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not the owner of the alleged mobile number from which the demand of extortion was made rather it is of another lady residing in Bangalore. There is no material against the petitioner except statement of the said lady that this mobile was used by this petitioner but petitioner is not
Patna High Court Cr.Misc. No.22713 of 2017 (2) dt.12-06-2017 2 / 2 related with the lady and has got no criminal antecedent. The First Information Report was lodged after three days of the alleged extortion call and charge sheet has been submitted in this case. Having considered the said facts and circumstances, petitioner, namely, Raushan Tanti @ Raushan Kumar Tanti @ Raushan Tanti is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Manjhaul, Begusarai in connection with Cheriyabariyarpur P.S. Case No.10 of 2016.
