JUSTICE BIRENDRA KUMAR ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 386, 121, 122, 124A of the Indian Penal Code, Sections 25(1b)a/26/35 of Arms Act and 17 C.L.A. Act & Sections 13,16,18, 20 of U.A./P.A. Act.

Three persons were apprehended on suspicion that they were members of the Naxal Group and were going to commit some crime. In their confession, name of the petitioner appeared.

Submission is that the petitioner is in custody since 24.07.2017 and nothing specific is alleged against him. Confession before the police by co-accused is no evidence against the petitioner.

Patna High Court Cr.Misc. No.7673 of 2018 (2) dt.08-02-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khizersarai Police Station Case No.41 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
