The petitioner seeks bail in a case instituted for the offences under Sections 341, 326, 307 of the Indian Penal Code and 25(1-b)a, 26 and 27 of the Arms Act.
Earlier, the petitioner was granted bail vide Annexure1 to the present application. Later on, bail bond of the petitioner was cancelled by the Court below by order dated 21.09.2019 for want of pairvi.
It has been submitted on behalf of the petitioner that the petitioner had left the village for treatment of his wife and hence, proper pairvi could not be made on his behalf before the Trial Court and for the said reason, the bail granted by the
Patna High Court CR. MISC. No.11033 of 2020(2) dt.19-02-2020 2/2 petitioner vide Annexure-1 was cancelled by the Court below vide order dated 21.09.2019. Thereafter the petitioner was taken into custody on 29.12.2012. The petitioner further submits that he had no intention to misuse the privilege of bail and only due to treatment of his wife, he could not appear on the date fixed by the Court. The petitioner undertakes that he shall be present on each and every date fixed by the Trial Court. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Munger in connection with Sessions Trial No. 33/2019 (arising out of Sangrampur P.S. Case No. 246/2018).
