This is a petition for grant of regular bail for offence under Sections 341, 342, 354, 354B, 457, 323, 376 and 511/34 of the Indian Penal Code.

Title Suit No. 45 of 2017 as well as a proceeding under Section 107 of the Criminal Procedure Code is going on between the parties. In the aforesaid background allegation is that the petitioner and co-accused, Dinanath Choudhary entered into the house of the informant and attempted to commit rape. Submission of the learned counsel for the petitioner is that the first information report is completely concocted one. The police authorities have simply find a case under Section 504 of the Indian Penal Code true as no independent witness has supported allegation of committing rape rather simply altercation had taken place for land dispute and the petitioner is in custody since 05.01.2017.

Considering the facts and circumstances, aforesaid,

Patna High Court Cr.Misc. No.22014 of 2017 (3) dt.21-06-2017 2/2 let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Bairia P.S. Case No. 248 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, IV, West Champaran at Bettiah, or successor Court.
