JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Kadwa P.S. Case No. 27 of 2017, registered under Section 365 of the Indian Penal Code.

The accusation is that on 05.02.2017 at about 4.00 P.M. Girija Devi, mother of the informant, had gone to Sonaili Bazar to purchase vegetable, where she met with Lakhi Devi, but mother of the informant did not return to her house. Thereafter, informant started searching her, but no trace was found and her both mobiles were found switched off.

Learned counsel for the petitioners submits that, in

Patna High Court Cr.Misc. No.20966 of 2017 (3) dt.21-06-2017 2/2 fact, petitioners and victim Girija Devi used to sell clothes roaming in the village due to that reasons, both the petitioners have falsely been implicated in this case mere on suspicion. Further submission is that in para-22 of the case diary it has been stated that on 05.02.2017, both the petitioners and Girija Devi were seen in the market and Girija Devi left the place for attending phone calls and both the petitioners returned after marketing, except that nothing has been collected against the petitioners and they are in custody since 24.02.2017. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-IV, Katihar in connection with Kadwa P.S. Case No. 27 of 2017.
