In this case, the petitioner is seeking bail in connection with Araria P.S. Case No. 311 of 2019 registered for offences punishable under Sections 379 of the Indian Penal Code. The petitioner has four criminal cases over his head with respect to identical nature of cases.

In the present case, the First Information Report has been lodged against the unknown persons for lifting a Honda Shine Motorcycle bearing registration no. BR11V 7045. In the confessional statement, the petitioner has confessed to be involved in the present case and he was also found with the stolen motorcycle.

Learned counsel for the petitioner has submitted that the petitioner has already remained in judicial custody for more than

Looking to the entire facts and circumstances of the case as also considering the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 311 of 2019, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass order, including cancellation of bail bonds and the petitioner will appear, in person, before the Araria police station on every 7th of each month for at least nine months.
