Petitioner apprehends his arrest in Jamui P.S. Case No. 321 of 2014 registered under section 302 and other allied sections of the Indian Penal Code.

It is alleged that on 15.12.2014 the informant and his family member after taking dinner were sleeping in his house and on alarm of Bideshi Yadav he came out of his house and found that his father was seriously injured and his father disclosed that Ganauri Yadav, Gorelal Yadav the petitioner, Karu Yadav , Shushil Yadav, Triloki Yadav and Sunila Yadav assaulted him. The informant brought his father to Sadar Hospital where he died.It is further alleged that Lutan Yadav and Ishwar Yadav also got injury.

No.14641 of 2015 (4) dt.26-06-2015 2/2 It is submitted that name of Lutan yadav and Ishwar Yadav have come in the first information report but Lutan Yadav did not disclose even the name of the petitioner and they did not raise any alarm. On the other hand learned A.P.P. submits that the injured had disclosed the name of the petitioner as assailant of the deceased.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on anticipatory bail. The same is rejected.
