JUSTICE MADHURESH PRASAD ORAL ORDER 12-04-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under section 366A of the IPC.

Learned counsel for the petitioner submits that this is a case of false implication and in fact there was affair between the petitioner and the victim and on her own volition she fled away with the petitioner.

This Court finds that the victim girl whose age has been assessed as 16 years, in her section 164 Cr.P.C. statement, has supported the allegation of having been removed from her guardians and the petitioner compelled her to establish physical relationship.

Considering the gravity of the allegation, this Court is not inclined to grant bail to the petitioner for the present. The prayer

Patna High Court Cr.Misc. No.13386 of 2018 (3) dt.12-04-2018 for bail of the petitioner is rejected.
