JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Jagdishpur P.S. Case No. 339 of 2019 for offences under Sections 341, 323, 379, 354(a), 354(b), 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

The allegation against the petitioner is that he had caught hold of the daughter of the informant and started pulling her for the purpose of marriage and on protest made by the informant, he took out Desi Katta to overpower her. It is further alleged that he had molested the informant and torn her clothes.

Considering the fact that the petitioner has no criminal antecedent, this Court is inclined to grant bail to him. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 339 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., subject to the condition that bailors should be female members of the same locality.
