Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323/34 and other allied sections of the Indian Penal Code.
Prosecution's case in short is that one Pappu Kumar and some unknown miscreants demanded Rs.13,000/- as rangdari from the informant. They forcibly took away informant's motorcycle, his voter ID card, mobile phone etc. when he was doing hawker work dealing with Sarees, Hotpot, LED light etc.
Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case on the confessional statement of co-accused Pappu Kumar. The main accusation has been made against the said Pappu Kumar. Petitioners have got no criminal antecedent and they have been
Patna High Court CR. MISC. No.11367 of 2020(2) dt.25-06-2020 2/2 implicated in this case only on suspicion as well as due to village politics. Nothing incriminating has been recovered from the possession of the petitioners during investigation to connect them with the alleged offence.
Considering the facts of the case, let the petitioners, above named, in the event of surrender before the Court below be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, Gaya in Paraiya Police Station Case No. 149 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
