1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in Belaganj P. S. Case No.500 of 2024 registered for the offences punishable under Sections 25(1-B)(a) of the Arms Act.
3. The learned A.P.P., at the outset, submits that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that he received an information from his superior that a person is flouting arms on social media which has created panic amongst the general public. Accordingly, the informant along with the police force reached the house of the petitioner where petitioner was apprehended, but then, on his disclosure the arms was not recovered, but the petitioner was given the benefit of Section 35 of the B.N.S.S. No.16735 of 2025(2) dt.16-04-2025 2/2 A.P.P. thus submits that since benefit of Section 35 B.N.S.S. has been given to the petitioner, as such, petitioner as of now, does not have any apprehension of arrest on which the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present anticipatory bail application with liberty to file a fresh if need arises.
4. Permission is accorded.
5. Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
