The petitioner seeks bail in a case registered under Sections 454/380of the Indian Penal Code.
The prosecution case in brief is that while the informant returned from his daughter's house, he found the lock of his main gate broken. The almirah of his wife and daughter in law was open. The articles were found scattered and ornaments worth Rs. 60,000/- was found missing.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-11-2018. Charge sheet has already been submitted. The petitioner is not named in the FIR. The name of the petitioner transpired in this
Patna High Court CR. MISC. No.15280 of 2019(2) dt.02-05-2019 2/2 case on the basis of confessional statement of co-accused. The petitioner has not been put on TIP. There is no recovery of any incriminating article from possession of the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Industrial P.S. Case No. 140 of 2018.
