JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-07-2017 Heard Sri. Dhananjay Kumar Tiwary, learned counsel for the petitioner and Sri. Madhura Nand Jha, learned A.P.P. for the State.

The petitioner, in the present case, is seeking regular bail in connection with Dumariaghat P.S. Case No. 33 of 2017 registered under Sections 504, 387 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that although in the First Information Report, there is an allegation that a demand of Rs. Fifteen Lac was made from the informant by a particular mobile number, however, the said mobile number (SIM) is not of the present petitioner. The mobile set is of the petitioner

Patna High Court Cr.Misc. No.28189 of 2017 (2) dt.06-07-2017 2/2 was lost some time back and the same seems to have been misused by some other persons. The SIM is registered in the name of Pramod Kumar and Dharmveer Kumar. So far as, the present petitioner is concerned, he has no criminal antecedent and is in jail since 12.03.2017.

Considering the facts and circumstances as also the submissions made hereinabove, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Motihari, East Champaran in connection with Dumariaghat P.S. Case No. 33 of 2017 Subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
