The petitioner seeks bail in Madanpur P.S. Case No. 14 of 2018 registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

180 liters of spirit is said to have been recovered from the outside house of the petitioner and petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. He has neither concern with the seized spirit nor with the place of occurrence. He has no criminal antecedent. He has been languishing in custody since 15.01.2018.

No.12782 of 2018 (02) dt.06-03-2018 2/ 2 In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-7-cum-Special Judge Excise, Aurangabad in connection with Madanpur P.S. Case No.14 of 2018.
