The petitioner seeks bail in a case instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Prosecution case, in short, is that 535.680 liters wine is recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.01.2020 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 535.680 liters wine is recovered from the car. The car in question does not belong to the petitioner. The name of the petitioner has transpired in this case on secret information. The

The petitioner had no knowledge regarding the alleged incident. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II-cum-Special Judge, Excise Act, Buxar in connection with Brahmpur P.S. case No.09 of 2020.
