The petitioner seeks bail in Jagdishpur P.S. Case No. 10 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code.
The petitioner is not named in the FIR. The informant lodged the case against unknown for theft of his tractor. Name of the petitioner figured in the case in the confessional statement of co-accused Karnal Singh but nothing has been recovered from the possession of the petitioner. On the basis of confessional statement of Karnal Singh the stolen tractor was recovered. The petitioner is in jail since 22.03.2017.
Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.27816 of 2017 (2) dt.29-06-2017 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Jagdishpur P.S. Case No. 10 of 2017. (Prabhat Kumar Jha, J.) KKSINHA/- U T
