JUSTICE BIRENDRA KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-AA), 25(1-B)A, 26, 35 of the Arms Act.

The petitioner is in custody since 23.05.2016.

Allegation is that a loaded country made pistol was recovered from possession of the petitioner. The petitioner has got criminal antecedent. The investigation is complete. Petitioner is ready to cooperate with the trial. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on framing of the charge or after expiry of three months from today

Patna High Court Cr.Misc. No.11408 of 2018 (2) dt.27-02-2018 whichever is earlier, if the trial is not concluded in the meantime, on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nathnagar Police Station Case No.102 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
