The petitioners have challenged the order dated 02.01.2013 passed by the learned Judicial Magistrate, Ist Class, Hilsa, Nalanda in Complaint Case No. 500C of 2012, whereby cognizance has been taken under Sections 341, 323 and 354/34 of the Indian Penal Code.

No good ground has been made out for this Court to interfere with the order of cognizance. However, the

Patna High Court CR. MISC. No.13701 of 2015(2) dt.08-05-2019 2/2 petitioners would be at liberty to avail of the remedies which are available to them under law.

In case, the trial of the petitioners has proceeded, the learned Trial Court would be under an obligation to conclude the same as expeditiously as possible. With the aforesaid observation/direction, the petition is dismissed.
