JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Darpa P.S.Case No. 46/2015 registered for the offences punishable under Sections 147, 148, 341,323,324,307,373 and 504 of the Indian Penal Code. The accusation is that on 18.05.2015 in the morning, the informant was present at her grocery shop, the nine accused including the petitioners named in the F.I.R. came and started abuse. When she made protest then they damaged and scattered the articles if shop. At that time, the daughter -in-law and son of the informant came to save her then co-accused Sanju Sahni gave farsa blow to the informant but it caused injury her daughter-inlaw. In the meantime, Bhulan Sahani gave knife blow at the neck

Patna High Court Cr.Misc. No.9688 of 2016 (2) dt.12-04-2016 2/2 of grand daughter of informant. The accused Lachhandeo sahni took cash of RS. 25,000/- to the shop of the informant. Learned counsel for the petitioners submits that occurrence took place on 18.05.2015 but the F.I.R. is instituted on 23.05.2015. It is further submitted that injuries as found on the person of daughter-in-law and grand daughter of the informant are simple in nature. Further submission is that petitioners have no criminal antecedent.

Considering the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender within a period of six weeks from today before the Court below be enlarged on bail on furnishing bail bonds of Rs, 10,000/- ( ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Darpa P.S.Case No. 46 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
