Patna High Court CWJC No.18558 of 2016 (2) dt.23-11-2017 2/2 The petitioner seeks cancellation of appointment of respondent nos. 11 to 16, who are relatives of Secretary, Principal and Members of Bhermara Madarsa School, Management Committee.
Learned counsel, appearing on behalf of the Bihar State Madarsa Education Board, submits that the petitioner is a resident of Delhi and he has no concern with the affairs of the said Madarsa. It has also been submitted that the petitioner has an alternative remedy to file appeal before appropriate court. It is apparent on reading of the pleadings in the writ application that the dispute is of private nature. The petitioner is said to have issued notice under Section 80 of the Code of Civil Procedure.
In that circumstance, since the petitioner had already chosen to take recourse to file a suit, he could not have filed the present writ application.
Accordingly, this application is dismissed.
