The petitioners seek bail in Panjwara P.S. Case No. 18/2016, registered for the offences punishable under Section 392 of the Indian Penal Code.
The informant alleged that while he was returning after collecting money of the Company, three persons came on a motorcycle and snatched Rs. 60,000/- from his possession at the point of pistol. The petitioners are not named in the F.I.R. During the course of investigation, petitioner no. 1 Chunchun Yadav was arrested and he is said to have confessed his guilt and he disclosed the name of petitioner no. 2 Pujan Yadav.
It is submitted that petitioners were not put on Test
Patna High Court Cr.Misc. No.27822 of 2017 (2) dt.30-06-2017 Identification Parade and nothing has been recovered from the possession of the petitioners. The petitioners are in jail for more than three months.
Considering the facts aforesaid and the fact that even after being arrested the petitioners were not put on Test Identification Parade and save and except confession of coaccused there is no other material against the petitioners, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Panjwara P.S. Case No. 18/2016.
