Earlier the prayer for bail of this petitioner was rejected by this Court passed in Cr. Misc. No. 37793 of 2024 vide order dated 12.07.2024 with an observation that the "learned trial Court is directed to conclude the trial within a period of six months from the date of receipt of a copy of this order and if the trial could not be concluded within specified period, the petitioner would be at liberty to renew the prayer for bail of the petitioner before the learned trial court." The petitioner is in custody in a case registered for the offence punishable under Sections 392, 397 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that similarly situated co-accused has been granted bail by this Court passed in Cr. Misc. No. 38351 of 2024 and 62939 of 2024. Petitioner is in custody since 16.12.2023 and nothing incriminating article has been recovered from the conscious possession of the petitioner. He next submits that on perusal of the impugned order dated 20.04.2024, it appears that there is no conclusion of the trial in near future.

Learned APP for the State opposes the prayer for regular bail of the petitioner and submits that the earlier prayer for bail of this petitioner was rejected by this Court. In view of the observation made by this Court dated 12.07.2024 passed in Cr. Misc. No. 37793 of 2024 as also the fact that similarly situated co-accused persons have been granted bail by this Court and petitioner is in custody for more than one year as also that there is no conclusion of the trial in near future as appears from the impugned order, so let the above named petitioner be released on bail on furnishing bail bond of
