Heard the learned counsel for the petitioners and learned APP for the State.

No.13975 of 2022(2) dt.28-09-2022 2/3 The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 354-B and 506/34 of the Indian Penal Code and Section 4 of the Prevention of Dian Act, registered in connection with Dhoraiya P.S.Case No. 110 of 2020.

As per allegation, the accused persons came to the house of the informant and after making allegation that she was dyne, they outraged her modesty and committed marpeet. The learned counsel for the petitioners has submitted that the petitioners are the persons of clean antecedent. There is case and counter case and petitioners have been granted the benefit of Section 41(1) of the Cr.P.C..

Considering the fact that the petitioners have been granted the benefit of Section 41(1) of the Cr.P.C., they are directed to surrender before the court below and make a prayer for regular bail. The learned court below shall dispose of the regular bail petition of the petitioners on the same day. The learned court below may take notice of the fact that the investigating authority did not require the custodial interrogation from the petitioners. The petitioners are the persons of clean antecedent.

With these observations, the application stands

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
