JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 504 and 307/34 of the Indian Penal Code.
It is alleged that the accused persons came variously armed when petitioner no.2 assaulted Ranjeet with 'garasa' and when younger brother of the informant came, he was also assaulted by the accused persons.
It is submitted by learned counsel for the petitioners that only Ranjeet received injury and the injury report of younger brother is not on record, a supplementary affidavit to that effect has been filed. Though, the injury of Ranjeet has been found to be
Patna High Court Cr.Misc. No.11582 of 2015 (3) dt.01-04-2015 2/2 grievous but for the occurrence of 05.11.2014, the FIR was registered on 23.11.2014 and the petitioners' side also lodged a case at earlier point of time when the accusation has been levelled in the background of land dispute.
Considering the delayed lodging of the FIR, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with Baheri P.S. Case No. 275 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
