The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379 and 504/34 of the Indian Penal Code. The prosecution case is that when the informant made protest for cutting of the bamboos the accused persons including the petitioners assaulted the informant by slaps and lathi. When wife of the informant came to rescue she was also being assaulted. It is alleged that petitioner no. 1 snatched rupees five thousand from the pocket of the informant. Patna High Court Cr.Misc. No.10268 of 2016 (2) dt.03-03-2016 2/2 petitioners that for the occurrence of 11.06.2014 the FIR was registered on 26.06.2014 through the written report submitted by the informant whereas the accusation has been levelled in the background of land dispute.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 127 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
