The petitioner is languishing in jail since 11.03.2017 in a case registered for offences punishable under Section 30 (a) of Bihar Excise Act.

The prosecution case as lodged on the basis of written report by the Sub Inspector is that on secret tip off the house of the petitioner's was searched and 57 liters of Nepali wine was recovered from her house.

It has been submitted by the learned counsel for he petitioner that she is a old lady and in the house of the petitioner other accused persons also reside. It has also been submitted that

Patna High Court Cr.Misc. No.24777 of 2017 (36) dt.21-06-2017 2/2 nothing has been recovered from the conscious possession of the petitioner and that the petitioner has no criminal antecedent. Learned A.P.P. for the State however opposes the prayer for bail.

Considering the facts and circumstance of the case and materials on record, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned Additional Sessions Judge- II, Supaul in connection with Misc. (Excise) Case No. 27/2017 arising out of Supaul P.R. No. 92 of 2017. (Nilu Agrawal, J) Sudha/- U T
