This is a case registered under Section 392 of the Indian Penal Code.
The allegation in the FIR is with respect to snatching of a motor cycle and a mobile set.
It has been submitted on behalf of the petitioner that the said looted mobile set was recovered from one Mukesh Kumar and on the basis of his confessional statement the petitioner has been implicated in the instant case even though nothing has been recovered from his possession. He further submits that even though there is one earlier case against him but he is on bail in the said case. He also submits that his name has falsely been dragged in the instant case as there is some dispute between said Mukesh
Patna High Court Cr.Misc. No.30051 of 2017 (2) dt.06-07-2017 2/2 Kumar and the petitioner arising out of mobile repairing business. The petitioner is in jail custody since 24.04.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Udakishunganj in Udakishunganj P.S. Case No. 43 of 2017.
